Nestle India has challenged a ban on its popular instant noodle brand Maggi

In a statement on Thursday, Nestlé India Limited said "As part of the effort to resolve the MAGGI Noodles issue," it has approached the Bombay High Court raising issues of interpretation of the food safety and Standards Act 2011, whilst seeking judicial review of an order by the Food and Drug Administration in Maharashtra, and a related order by the Food Safety and Standards Authority of India (FSSAI), both issued last week. 

At the same time, the food and beverages company said it is continuing the withdrawal of MAGGI Noodles products from outlets. Nestle also made it clear that the legal action will not interfere with this process. 

Nestle was forced to recall of nine variants of the instant noodles after FSSAI said it is unsafe and hazardous for human consumption.  

The brand has been facing sales ban in several states in India, as tests recorded higher levels of lead and monosodium glutamate or MSG. Excess amounts of lead can cause kidney and bone disorders. MSG, when used for a long period, is said to damage human nervous system. 

India's capital New Delhi and six other states have imposed ban on the noodles brand on the basis of adverse lab reports. FSSAI said other noodle brands also will be tested.  

Nestle's global Chief Executive Officer Paul Bulcke had claimed that the brand is safe for consumption and it maintains same standards of quality all over the world. Bulcke said product quality and safety are of paramount priority for the company, and the company does not add monosodium glutamate. 

Maggi "two minute" noodles has been there in the Indian market for the last 30 years and has been a major revenue contributor to Nestle in India.(dpa)
